These Terms of Use ("Terms") govern your access to and use of trackretirement.com and our annuity comparison and matching services (collectively, the "Services"), operated by Virtual Blue Agency LLC, a Wyoming limited liability company doing business as "Track Retirement" ("Track Retirement," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Effective date: June 25, 2026. Last updated: August 1, 2026. Please read Section 16 (Arbitration and Class-Action Waiver) carefully — it affects your legal rights.
1. Who we are; eligibility
The Services are provided by Virtual Blue Agency LLC (Wyoming entity ID 2026-001913781), d/b/a Track Retirement, 30 N Gould St, Ste R, Sheridan, WY 82801. You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an entity, you represent that you are authorized to bind it.
2. What Track Retirement is — and is not
Track Retirement is an independent publisher and marketing/referral service. We provide educational information and tools to help consumers compare annuity products and connect with third-party providers. We are not an insurance company, insurance agency, insurance producer, broker, registered investment adviser, financial planner, accountant, attorney, or fiduciary, and we do not sell insurance or securities. Using the Services does not create an agency, advisory, fiduciary, or professional-client relationship between you and us.
3. No professional advice
All content on the Services is general information for educational and comparison purposes only and is not individualized financial, insurance, investment, tax, legal, or retirement advice, and is not a recommendation to buy or sell any product. You should consult a licensed and qualified professional before making any financial decision. You are solely responsible for evaluating the merits and risks of any product or transaction.
4. No guarantee of accuracy; illustrative figures
Rates, payouts, fees, carrier ratings (including A.M. Best, Comdex, and similar), rankings, comparisons, calculator outputs, and other figures on the Services are illustrative and for general comparison only. They may be estimates, samples, incomplete, or out of date, are not quotes, offers, or guarantees, and are subject to change without notice. Actual terms depend on the issuing carrier, your circumstances, and underwriting. Always verify any figure directly with the carrier or a licensed advisor before relying on it. We do not warrant the accuracy, completeness, or timeliness of any content.
5. Annuities and insurance — important disclosures
Annuities are long-term contracts issued by insurance companies and may involve surrender charges, fees, holding periods, and tax consequences. Annuity guarantees are backed solely by the financial strength and claims-paying ability of the issuing insurer, not by Track Retirement, and are not insured by the FDIC, NCUA, or any government agency. Track Retirement is not a party to, and is not responsible for, any contract, quote, illustration, or transaction between you and any carrier, agency, or advisor.
6. Matching, lead generation, and third parties
When you request matches, a quote, or to be contacted, you authorize us to share your information with, and to introduce you to, third-party insurance carriers, agencies, licensed advisors, and marketing partners, who may contact you and present products and services (see our Privacy Policy). Your dealings with any third party are solely between you and that third party. We do not endorse, guarantee, or assume any responsibility for any third party or its products, services, advice, conduct, or representations, and we are not liable for any loss arising from them. We may be compensated when you request matches or take qualifying actions; see our Advertiser Disclosure.
7. Communications consent (TCPA)
By submitting your contact information, you agree to be contacted as described in our Privacy Policy, including by call and text message (which may be autodialed or use a prerecorded or artificial voice) for marketing and informational purposes. Consent is not a condition of any purchase. Reply STOP to opt out of texts.
8. Acceptable use
You agree to use the Services lawfully and not to: violate any law or third-party right; submit false, misleading, or another person's information; access the Services by automated means (scraping, bots) without our permission; introduce malware; interfere with the Services' operation or security; or use the Services to harass, defraud, or impersonate.
9. Intellectual property
The Services and all content, software, text, graphics, logos, and trademarks are owned by Track Retirement or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. You may not copy, reproduce, scrape, republish, or create derivative works without our prior written consent.
10. Disclaimer of warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS ACCURATE OR CURRENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACK RETIREMENT AND ITS AFFILIATES, MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FINANCIAL LOSS, ARISING FROM OR RELATING TO THE SERVICES, ANY CONTENT, OR ANY THIRD PARTY WE INTRODUCE YOU TO, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless Track Retirement and its affiliates and their respective members, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms or any law, or your dealings with any third party introduced through the Services.
13. Third-party sites and services
The Services may link to or integrate third-party websites and services that we do not control. We are not responsible for their content, products, or practices, and your use of them is at your own risk and subject to their terms.
14. Changes to the Services and Terms
We may modify or discontinue the Services, and may update these Terms, at any time in our discretion. Material changes are effective when posted, and the "Last updated" date above will be revised. Your continued use after changes constitutes acceptance.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections that by their nature should survive termination (including Sections 3 through 7 and 9 through 18) will survive.
16. Arbitration; class-action and jury waiver
Please read this section carefully. Except for small-claims matters and claims for injunctive relief regarding intellectual property, you and Track Retirement agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Any in-person hearing will be held in the county where you live, or, at your election, conducted by telephone or videoconference or decided on written submissions. We will pay the arbitration filing, administration, and arbitrator fees to the extent they exceed what it would cost you to file the same claim in court. You and we waive the right to a jury trial and to participate in any class, collective, or representative action. Before starting an arbitration, you agree to email support@trackretirement.com with a short description of the dispute and the relief you want, and to give us 30 days to try to resolve it informally. You may opt out of this arbitration agreement by emailing support@trackretirement.com within 30 days of first accepting these Terms.
17. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Subject to Section 16, the exclusive venue for any permitted court action is the state or federal courts located in Wyoming.
18. Miscellaneous
These Terms, together with the Privacy Policy and Advertiser Disclosure, are the entire agreement between you and us regarding the Services. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms; you may not without our consent. Headings are for convenience only.
